Privacy is the foundational pillar of our platform at Clever Games. We operate on a philosophy of data minimization and radical transparency to ensure full compliance and safety.

The Clever Games Privacy Promise

1. We never sell or rent student data to third parties.
2. We never display advertisements of any kind on our platform.
3. We never permit our AI partners (e.g. Google, OpenAI) to train their public models on student prompts or creations.

COPPA & FERPA Compliance

COPPA (Children's Online Privacy Protection Act)

Clever Games strictly adheres to COPPA guidelines. We rely upon schools and school districts to provide necessary consent on behalf of parents for students under the age of 13 to utilize the platform in an educational setting. We do not require, and actively discourage, students from providing Personally Identifiable Information (PII) beyond what is strictly necessary for account provisioning (typically just an opaque student ID or anonymized display name).

FERPA (Family Educational Rights and Privacy Act)

In our capacity as an educational service provider, Clever Games acts as a "School Official" with a legitimate educational interest. All student records, including generated games and curriculum progression data, remain the exclusive property of the school or district. Schools retain the authority to audit, modify, or permanently delete student records at any time via the Instructor Dashboard.

Information We Collect

To provide a personalized learning experience, we securely collect and store:

  • Account Data: Opaque user IDs, display names, and school/class associations.
  • Educational Data: Game prompts, generated game state (JSON logic, asset paths), and curriculum completion milestones.
  • Telemetry: Anonymous, aggregated metadata to ensure system reliability and uptime.

Generative AI & Third-Party Processors

When a student writes a prompt to design a game asset or define logic, that prompt is processed by our enterprise AI sub-processors (such as Google’s Gemini API). Our enterprise agreements legally mandate that:

  • Prompts are processed ephemerally and discarded after game/asset generation.
  • Data is encrypted in transit using industry-standard TLS 1.3 and at rest using AES-256.
  • Zero data is retained for machine learning or foundational model training purposes.
