Terms of Service

1. Platform Administration & Scope

Clever Games provides an educational Software-as-a-Service (SaaS) platform intended for use within K-12 schools, coding bootcamps, and educational institutions. Account creation and provisioning must occur under the explicit supervision of a verified instructor or district administrator. Instructors hold primary responsibility for monitoring student activity within their designated virtual classroom.

2. Acceptable Use Policy (AUP)

Clever Games is a safe, walled-garden digital sandbox. Users explicitly agree NOT to generate, attempt to generate, publish, or distribute games/assets that contain or promote:

• Hate Speech & Bullying: Harassment, discriminatory language, or targeted attacks against any individual or group.
• Inappropriate Content: Adult themes, explicit language, sexual content, or excessive violence/gore.
• Personally Identifiable Information (PII): Do not embed real names, addresses, phone numbers, or social media handles into game assets or logic.

Violation of this Acceptable Use Policy will result in immediate intervention. We utilize automated AI-moderation pipelines alongside manual instructor review to enforce these standards.

3. Intellectual Property and Content Ownership

Unlike many generative AI platforms, Clever Games believes students should own what they build. Consequently:

• Student Ownership: Students retain full ownership of the intellectual property inherent in the games they design on the platform.
• License to Clever Games: By utilizing the platform and saving games to the library, you grant Clever Games a limited, worldwide, non-exclusive license to host, display, and technically format the game for educational showcase purposes (e.g., displaying the game on a public `/play/[slug]` URL upon explicit user publish action).

4. AI Generation & Liability Disclaimer

Clever Games leverages advanced generative artificial intelligence to translate student prompts into playable game assets and JSON logic structures. While we implement rigorous, multi-layered enterprise guardrails to moderate inputs and outputs, AI can occasionally behave unpredictably. Clever Games provides the platform "AS IS" and assumes no liability for unintended, anomalous, or unsuitable content occasionally produced by the foundational models. Instructors retain the ultimate authority and capability to reject, unpublish, or delete student drafts prior to public library showcasing.

5. Termination

We reserve the right to suspend or permanently terminate access to accounts (both student and instructor) that systematically violate these Terms of Service, particularly those that attempt to 'jailbreak' safety filters or harass other users.
